Performance of the contract and cancellation: HOTEL PENSION OSTLER

The contract (accommodation agreement) comes into force by means of a binding booking (oral, written, by fax, e-mail or phone). The provider (hotel) undertakes to perform the contractually owed services. The guest undertakes to make use of the services, or in the case of non-use to repay the sum due.

Cancellation or non-appearance:

We would point out that the guest – regardless of the type of booking – has no general cost-free right of withdrawal or revocation with regard to the concluded contract for accommodation. According to § 312g para.(2) No.9 BGB (German Civil Code), in the case of a cancellation or other non-utilisation of the booked services, the hotel’s claim for payment for the agreed accommodation price remains. The hotel will make every effort in good faith to hire out the service to another party. If this is unsuccessful or only partly successful, cancellation costs are due. In accordance with the recommendations of the Deutscher Hotel und Gaststättenverband (German association of hotels and inns), conditions of accommodation and jurisdiction, we will in the in the event of cancellation, non-appearance or early departure set the following costs for cancellation. The agreed accommodation price minus the expenses saved as follows: for an overnight stay with breakfast, minus 20%. The guest is entitled to prove a greater saving in expenses than has been charged. We therefore recommend taking out a travel insurance policy. Cancellation should, for technical reasons, be directed to the booking department and, in the guest’s own interests, it should be made in writing.

Arrival and departure conditions:

Unless otherwise agreed, the room will be available on arrival at 1.00 p.m. Guests should inform the hotel in good time if arrival is to be later than 6.00 p.m. If the hotel is not informed, it has the right to allocate the room elsewhere for the next day. Unless otherwise agreed, the accommodation must be vacated by 10.30 a.m. on the day of departure.

Obligations of the guest:

The guest is to report defects in the accommodation or the booked services immediately or to request remedy. Only the agreed number of persons may be accommodated in a room; infringement of the above may form a reason for the hotel to demand increased charges or terminate the contract. Bringing in pets of whatever kind is not permitted. The guest is to treat the furnishings and equipment on the hotel premises with care. In the event of damage or gross soiling of furnishings or equipment, the guest is liable to the hotel for payment of the costs of new acquisition or cleaning costs.

Further conditions:

Liability for or taking on the duty of supervision of minors by the hotel is excluded.
